Roles of TSC Disciplinary Panel Members

SUMMARY OF THE ROLES OF DISCIPLINE PANEL MEMBERS AT THE COUNTY

1. Chair of the Panel

The Panel Chair shall:

  • Be responsible for conducting the discipline proceedings from the start to the
  • Ensure that the proceedings are conducted in a fair and efficient process in accordance with the regulations and the
  • Request the   teacher   to identify himself /herself             and                 to hand         over his /her personal documents as per the letter of invitation and require the teacher to swear or
  • Ask the teacher to confirm whether he/she received his/her letter of interdiction and read the allegations as outlined in the letter of interdiction.
  • Require the teacher to plead to the charges and require the presenting officer to prosecute the case.
  • Require the teacher to cross-examine the witnesses and allow the teacher’s witnesses to testify after the Commission’s case.
  • Allow any member of the    panel to ask any relevant question at any stage during the
  • Accord the teacher an opportunity to make his/her final statement and return to the teacher all his/her personal documents at the end of the
  • Guide the panel in making the final decision on the teacher’s case
  • Sign and date the discipline proceedings
  • Be responsible for the preparation and submission of the ratification summary to the TSC
  • Ensure that the records relating to the discipline process are kept in safe
  • Ensure that the decisions of the discipline panel are kept confidential until the accused teacher is informed of the decision

2.              The second member of the panel

The member shall:

  • Be in-charge of recording the discipline
  • Ask relevant questions to the accused teacher and seek
  • Participate in making decisions on the case before the

3.              The County Director of Education

The CDE shall:

  • Guide the panel on policies related to the Basic Education Sub-

4.              The Discipline Officer

The discipline officer shall:

  • Record the Interdiction in the Interdiction Register and cross-check the interdiction to ensure no double registration.
  • Open a Case File for the interdiction and assign it a Case (e.g. for a case in Kisumu: KSM/001/04/2016/2017).
  • File an interdiction
  • adjust the salary of the interdicted teacher as per the charges (before the -payroll is decentralized the discipline officer will link up with the headquarters for adjustment of the salary).
  • Prepare the case for hearing as per the interdiction check-list and program the case for
  • Invite the teacher in writing and witnesses (where applicable) for hearing of the
