Three Kenya National Examination Council (KNEC) contracted examination agents were today arraigned before a Kapenguria Law Court to answer charges of failing to prevent an examination irregularity in the ongoing Kenya Certificate of Secondary Education (KCSE) examinations.

The three, namely Wilson Limakou, Sila Poriot, and Mercyline Cheruto, with others not before the court, were arrested at a private KCSE examination centre within West Pokot Sub County where they had been assigned to manage.

The agents are alleged to have allowed candidates to be in possession of unauthorised electronic devices, namely mobile phones, without lawful authority while the examination was in progress.

The three were apprehended by police officers with the gadgets said to be containing examination papers on November 5, 2024, at the examination centre.

The prosecution held that the accused persons had contravened Section 40A of the Kenya National Examinations Council Act No. 29 of 2022 regarding the conduct of examination officials, hence liable for prosecution.

Before Chief Magistrate Benard Ondego, the three accused denied the charges and were each granted a Sh10,000 bond and sureties of similar amounts.

The magistrate fixed November 12, 2024, for mention of the pre-trial.
